DMCA Takedown Policy

Effective: September 1, 2025

This policy explains how to report alleged copyright infringement on https://binaryrogue.com/ (the “Site”) and how we handle valid notices and counter-notices under the U.S. Digital Millennium Copyright Act (17 U.S.C. §512).

1) Designated Agent

Important: We may share your notice (including contact details) with the user who posted the content, our hosting/CDN, or legal authorities as needed to evaluate and resolve the claim.

2) How to File a Proper DMCA Notice

Your notice must include all of the following (17 U.S.C. §512(c)(3)):

  1. A physical or electronic signature of the copyright owner or authorized agent;
  2. Identification of the copyrighted work claimed to be infringed (or a representative list);
  3. Identification of the material that is claimed to be infringing with enough detail to locate it on the Site (URL(s) required);
  4. Your contact information: name, address, telephone, and email;
  5. A statement of good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Notices that lack required elements may be rejected or delayed. Misrepresentations may expose you to liability for damages (17 U.S.C. §512(f)).

3) What We Do When We Receive a Valid Notice

  • We may remove or disable access to the identified material.
  • We notify the user who posted it and provide the substance of your notice.
  • We preserve a record of the removal and may notify our hosting or network providers.

Reservation of rights: Removal is not an admission of infringement. We may restore content if we receive a valid counter-notice and the complaining party does not file an action in court within the statutory window.

4) How to File a Counter-Notice (If Your Content Was Removed)

Your counter-notice must include (17 U.S.C. §512(g)):

  1. Your physical or electronic signature;
  2. Identification of the material removed or disabled and the location before removal (URL);
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, telephone, and email;
  5. A statement that you consent to the jurisdiction of the federal district court for your address (or for the Eastern District of Michigan if outside the U.S.) and that you will accept service of process from the person who filed the original notice or their agent.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. Unless we receive notice that the complainant has filed an action seeking a court order, we may restore the material in not less than 10 and not more than 14 business days.

5) Repeat Infringers

We may terminate accounts or block access for users who are the subject of three valid DMCA notices within a 12-month period, or sooner in our reasonable discretion for egregious cases. We also may remove related content, restrict features, or take other proportionate measures to protect the Site and its users.

6) Abuse & Bad-Faith Claims

Knowingly submitting false notices or counter-notices is prohibited and may result in liability, account restrictions, or referral to appropriate authorities. We reserve the right to seek damages, fees, and equitable relief where warranted.
